Internet Gambling Laws: U.S., U.K. And the World

Legal minds turned to Internet gambling laws as a specialty when the industry went beyond growth and exploded into the public mind. “The law surrounding Internet gambling in the United States has been murky, to say the least,” according to Lawrence G. Walters, one of the attorneys working with www.gameattorneys.com.

In contrast, Internet gambling laws in the U.K. have made the lives of providers and players a bit easier. The passage of the Gambling Act of 2005 has basically legalized and regulated online play in the U.K.

With the objectives of keeping gambling from promoting “crime or disorder” the U.K. act attempts to keep gambling fair, in addition to protecting younger citizens and others who may be victimized by gambling operation. Unlike the United States, which still clings to the 1961 Wire Wager Act, the U.K. significantly relaxed regulations that are decades old. A gambling commission was established to enforce the code and license operators.

A Whole Other Country

According to Walters and many other observers of the Internet gambling laws scene, the United States Department of Justice continues to view all gambling on the Internet as illegal under the Wire Act. But there are details in the federal law that defy attempts to throw a blanket over all online gambling.

The Wire Wager Act forms the basis for federal action on Internet gambling laws in the United States. The law was meant to complement and support laws in the various states, focusing primarily on “being engaged in the business of betting or wagering” using wire communication to place bets or wagers on sporting events or similar contests. The law also comments on receiving money or credit that results from such a wager. The keys are “business,” “money or credit” and “wire communication facility.”

But as many attorneys and proponents of fair Internet gambling laws emphasize, the federal law does not specifically address other forms of gambling. This has left the law open to interpretation when it comes to online casinos specifically and using the World Wide Web to play online games.

October 13, 2006 is a crucial date in the controversy surrounding the legalization of gambling. For anyone wishing to understand Internet gambling laws, the federal law passed on that day is essential knowledge. President George W. Bush signed the Unlawful Internet Gambling Enforcement Act (UIGEA), which is intended to limit some “financial transactions” used for online gambling.

But even if current federal gambling laws can clearly define something as simple as a legal gambling age, the newer UIGEA has not settled all the dust raised around the issue of online gambling. Attorneys such as Walters (and many others) have pointed out that the UIGEA seems to refer only to financial transactions and wagers that are illegal where the wager or transaction is made. Some wagers may be legal while others may not be legal. It’s as simple as that.

The UIGEA had some effect on Internet gambling, in that many successful companies got out of the business, at least in the United States. In fact, with the passage of the law in 2006, most U.S. online players found they could not play at an online casino or poker room, for a short time. Many of the gambling providers found ways to establish offices and servers outside of the U.S. so that could invite United States players back in.

Break Time

It’s now time to stop, take a deep breath and turn to Internet gambling laws in the various states. Some have passed their own rules and regulations (before and after UIGEA). In a few states, companies cannot operate an online gambling business. In other states it is illegal for an individual to place a bet using the Web. Some legal experts argue that these individual-state rules are unconstitutional since commerce across state lines should only be regulated by federal law, not state law. Commercial online gambling businesses don’t operate in the United States, however. If you want to visit their “home offices” you may have to travel to Malta, Gibraltar or Curacoa.

The 2005 U.K. law generally allows remote sites such as these. The rules are not so relaxed in the U.S. However, a recent appellate court ruling in the U.S. states that, in at least one case, an Web-based gambling site did not violate states laws. Most legal minds urge gamblers and others interested in the issue to stay tuned.

Some have given their attention to finding benefits of legalized gambling, noting that this huge industry might be a key to economic recovery in the United States. At the heart of their argument are examples such as established lotteries run by various states, in addition to the government revenues that flow in to state coffers from riverboats and land-based casinos.

Part of this effort rests on the shoulders of more than 100 legal representatives working for common sense in Internet gambling laws. This hoard of attorneys has the task of trying to keep the World Wide Web/Internet free from government intervention.

Bob Ciaffone is considered one of the experts on the subject of gambling and poker in general, and on the transition to online gambling. He suggests that any regulation of Web-based gambling should reduce competition from outside the U.S., so that the citizens of the U.S. would benefit in legal gambling states. His detailed plan would parallel the U.K. situation since that country passed its 2005 rules. Ciaffone also strongly urges U.S. lawmakers to keep Internet gambling laws separate from the 40-year-old Wire Act, which was passed to control illegal gambling over the telephone.

In essence, Ciaffone writes that the UIGEA attempted to do the right thing, but does it in all the wrong ways. The restrictions have severely handicapped what could be a great revenue source with proper regulation, according to Ciaffone.

Consider a statement on the UIGEA from the most-recognizable poker player in the world, Doyle Brunson. Though is comments apply to his favorite game of poker, they can easily relate to all Internet gambling laws. He said, in essence, that his company received good legal advice that indicates Internet poker is not “expressly” illegal. He encourages U.S. players to learn the laws of their own state.

While this brief summary touches only the high points of a huge and complex subject, there are sources that have already compiled details for the various states. Check these sites:

Win More Chess Games Using the Ancient 36 Strategies

Chess is a game of substitute war, so you will win more chess games by taking advantage of the ancient wisdom distilled from the art of military strategies. This includes a collection of strategies compiled in China at least 1,500 years ago.

These strategies are taught to school children all over China, Japan and probably much of the rest of Asia even today.

If you think Chinese children learn the 36 Strategies as “classic literature” the same way American children must read Mark Twain . . . you are too foolish and naive to be allowed near a serious chess tournament.

You also should never try to do business in Asia, but that’s another article.

You must first of all understand that the essence of warfare is deceit. This is challenging in chess, because both players can see the entire board and all the pieces.

You must learn to make moves that advance your strategies and tactics without revealing them to your opponent until it’s too late. Of course, this is easier to write than to pull off in an actual chess game.

And it does require you to work, study and plan.

Your opponent can see the chessboard — but not what’s going on inside your mind.

You must learn to use that to your advantage. It requires a mental attitude and preparation which studying the 36 Strategies can help you acquire.

Some of the strategies to adapt to your chess game include:

Surrounding Wei to Rescue Zao — do not attack your enemy where and when he is strong. Avoid direct confrontation. Aim for their weak points.

Make the Enemy Work While You Wait at Leisure — when you are in a weak position, delay the confrontation.

Watch the Fire Burning Across the River — Exercise patience and allow favorable events to progress.

The Plum Tree Sacrifices for the Peach Tree — this is an ancient stress tactic. Sacrifice a piece for the greater good of your game.

Walk the Sheep Home Just Because It Is There — take advantage of all opportunities to gain an advantage.

Trade Your Brick for a Piece of Jade — if you want to trade pieces to your advantage, convince your opponent your brick is worth more than their piece of jade.

Pretend to Be a Pig to Eat the Tiger — make your enemy believe you are weak so they will attack and fall into your trap.

Be Wise But Play the Fool — make your enemy underestimate you.

Provoke Strong Emotion — upsetting or angering your opponent can encourage them to make mistakes. You must learn to remain calm so that you don’t fall into this trap.

The Empty City — when you are in a weak position, emphasize your vulnerability, to confuse your opponent.

Chain Links — this simply refers to using a chain of interlinked strategies to attain your goal.

Of course, real chess masters apply tactics against their enemies away from as well as on the chess board. Boris Spassky was reportedly a master at keeping a poker face during games, so that his opponents didn’t know whether he was feeling good or bad about his moves, his position or his plans.
However, Bobby Fischer made so many demands during their famous tournament that he was able to Provoke Strong Emotion.

In MORTAL GAMES: THE TURBULENT GENIUS OF GARRY KASPAROV Fred Waitzkin relates how during one of his world championship tournaments against Anatoly Karpov, Kasparov’s business partner Andrew Page played a “dirty trick” to upset Karpov.

They were all flying from New York City to Lyon France. The tournament organizers had given First Class tickets to both Kasparov and Karpov and Economy class tickets to their trainers. Page bought Business Class tickets for Garry’s grandmaster trainers, paying for them out of his own pocket. Karpov’s group was made to feel angry and resentful of their inferior accomodations.

Later, Karpov may have gotten a blow of his own in. Gata Kamsky proposed that their chess organization change the rules so that defending world championships would have to compete to play in the world championship tournament just like all other contenders, instead of simply defending their title against the winner of the playoffs.

It was designed to make defending champion Kasparov angry, and one of his people told Waitzkin the idea probably came from Karpov who was friends with Kamsky. Gata was a teenager at the time and not likely to propose such a major rule change on his own. But if Karpov had proposed it directly, it would just have made him look bad, since he was the world’s number two player and would therefore most benefit from it.

Bottom line: learn the 36 Strategies if only to recognize when your opponent tries to use one of them against you.

Find Free Gift Cards – No Survey Necessary

One of the best ways to save money, get the things you want, go out to eat, and in general lead the lifestyle you have become accustomed to without spending the money you have earned with so much work, is by obtaining free gift cards online.

No, it is not a joke, or a scam. These really do exist, and they really can be used at real stores, restaurants, even at the grocery store. To acquire them the company that offers them does require some simple participation. This does not necessarily mean you are going to spend hours filling out complicated surveys, but there will be some simple questions.

Hector Milla Editor of the “Free Gift Cards Online” website — http://www.FreeGiftCardsOnline.net — pointed out;

“…You want it to be the – real deal – don’t you? If you were told you it was totally free, then it would probably be some sort of scam, so here is the ‘beef.’ You will be required to participate. But most of the forms that have to be filled out are just multiple choice questions and only take about 5 to 10 minutes…”

This is a project you want to start on when you don’t have much to do, when the housework is done, and the kids are in bed. This is what you want to do instead of going to those poker sites to play ‘free gambling’ because you just can’t afford to lose any of the money you don’t have.

So although the free gift codes are not really surveys, they do ask you for some participation, and in exchange for that participation they reward you. These rewards can be as little as $5 to as much as $1000, it really depends on how much you want to participate.

“…The best suggestion is that you try them out for a while, and give it a couple of weeks. You will see that the small amount of time you end up participating, is fully compensated by the company, and once you and your family start enjoying the shopping, and the eating out again, then you will realize what a great deal these free gift card sites can be…” added H. Milla.

Strategies for Online Roulette – Do They Work?

Before you start looking for winning strategies, you need to understand one cardinal truth. The past has no influence on future. There is no 100% successful strategy for winning roulette or any other casino game.

Many casinos offer a pre printed card with all the numbers printed on it for the bettors to keep a track of what numbers have been hit and what have not. This strategy never works. If it did work, the casino will ban players from doing it. So, if the casinos are lending you a helping hand, there is something fishy about it.

Still, there are some basic underlying principles which can amount to strategies. First, play a European roulette, which has only one zero and only 37 slots. The American roulette has an extra 00, totalling to 38 slots. This gives the advantage to the house. So play European roulette to get better advantage.

Never bet all over the table on all numbers. You may win, but this money will be very less compared to what you would have betted. Playing online means, the mechanical wear and tear of the roulette wheel to favour a particular set of number is reduced. Gives you a fair game and you can learn and test strategies for free with free online roulette websites.

Strategy #1

In online roulette, you get bonuses. This is not part of real life casino. That adds advantage to you. While placing bets, decide on certain amount you can afford to lose. Let say a $ 500 or £ 250. Start playing by betting 10% of what you decided to lose which is $50 or £25. Stop playing when you have reached half of what you thought you will lose that is $300 or £125. Playing for bets that give you half the advantage like black/red, odd/even, high/low.

Strategy #2

This is a famous strategy and wins decent payments. Place 1 chip on red, one on 2-35 column and one on 3-36 column. This way, you will cover most of the numbers on the roulette and cover your loses.

Strategy #3

Double your stakes when you lose a bet and bring it back to the least bet after a win. This way you can cancel out any big lose. If you keep doubling after a win, you are bound to lose all the money. You need to keep a strict watch on your bankroll as well.

Other strategies are more complex and are not for beginners. They are Martingale betting system, Labouchere strategy, pivot and shower strategy.

For online gambling, you should think in terms of a long term strategy. Never pay money for the strategies that promise a lot, but deliver nothing. Hence you should play more with the above proven strategies than waste time and money of fraud betting strategies. These fraudulent websites are there just to swindle your hard earned cash.

Gambling in Nevada

Situated in the western region of the United States, Nevada is known as the silver state, not because of its rich gambling history but originally because of the large silver lodes discovered there in the late nineteenth century. A state that is largely comprised of desert, it is an interesting fact that more than eighty percent of Nevada’s land mass is controlled by the US military, and there are some immense bases there. When you consider that the total population of Nevada is less than two and a half million and the land mass is almost three hundred thousand square kilometers, then you will understand that the average Nevadan has a lot of space, and most of it empty, surrounding them.

Although Nevada has its share of industry and agriculture, by far and away the largest share of its income is in tourism, and particularly from those people who flock to the vast gambling centers in Reno and especially Las Vegas. Over 85% of the population of Nevada lives in and around these two centers, and the majority will be involved directly in the gambling industry or in the services surrounding it. One wonders what would have been the fate of Nevada if their early legislators had not possessed the vision and foresight to legalize gambling. In truth, gambling was illegal in Nevada from 1909 till 1931. Legal gambling was reintroduced, not really due to public demand, but because the state’s government felt that they had nothing to lose, such was the sorry state of Nebraska’s economy due to the grim depression era of that time. It would be unfair to say that the gambling industry in Nevada was an overnight success and in fact it wasn’t till the post war boom years of the fifties and sixties that gambling in Nevada began to make the massive step forward that it did.

This was due to the foresight and daring of a few pioneers of the gambling industry in the state, who were prepared to invest in the long term future of the state and the gambling industry that they believed could be established there. The state of Nevada played no small part, and their liberal laws based around many forms of popular entertainment acted as a major incentive in drawing visitors to the state. These visitors brought with them valuable tax dollars as well as much needed jobs.

Initially Nevada attracted gamblers from its neighboring states, Oregon, Idaho, Arizona, Utah and most prominently California. People would catch an early flight from Los Angeles to spend a long weekend in Las Vegas or Reno and enjoy all the latest entertainers as well as spending time gambling at their table favorites such as blackjack, craps and roulette. For those who loved to watch the slot wheels spin, there were rows and rows of machines available wherever you went, even at the airport when you arrived. Not that gambling was illegal in any of these states, just that it was nowhere as well developed as it was in Nevada.

Over the years the gambling industry has developed to such fantastic proportions that the state has become a global tourist attraction. In recent years, the casino resorts and hotels have fought to exceed themselves both in the luxurious surroundings they provide as well as the innovative attractions they provide for their visitors.

Some of the major attractions Las Vegas has provided over recent years are the huge live televised Texas Hold’em poker tournaments, with the jewel in the crown being the final of the World Poker Tour, with a first prize of one million dollars in cash. Many of the contestants taking part have won their seat at the table through winning a major online texas hold’em poker tournament, and some of them have even taken home one of the major prizes that are there to be had. Gambling in Nevada continues to go from strength to strength and there is no reason to expect that it will ever go backwards. Nevada is an example of a forward thinking state that realized that gambling is entertainment to the majority and should be encouraged.
